1.Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website operated at offlineresilience.com, the SurviveRx offline resilience hardware appliance, and all related software, subscriptions, and services (collectively, the "Services") provided by Offline Resilience Systems ("SurviveRx," "we," "us," or "our"). By placing an order, creating an account, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2.Eligibility

You must be at least 18 years old and able to form a legally binding contract to purchase the Services. You are responsible for ensuring that your use of the hardware and content complies with all laws in your jurisdiction.

3.Orders, Pre-Orders, and Deposits

The SurviveRx appliance is currently offered on a pre-order basis. A pre-order requires a refundable deposit of $99 per unit, which reserves your place in the build queue. The estimated ship window is October 2026. The remaining balance and any subscription charges are not collected until your unit ships. Deposits are fully refundable as described in our Refund & Cancellation Policy. All orders are subject to acceptance and availability, and we may cancel and refund any order at our discretion.

4.Pricing and Payment

Prices are listed in U.S. dollars and are subject to change before an order is placed. Payments are processed by our third-party payment processor, Stripe, Inc. By providing payment information you authorize us and Stripe to charge the applicable amounts. You agree that we may store a payment method to collect the remaining balance and start your subscription when your unit ships. Applicable taxes and shipping are added at checkout or at fulfillment.

5.Subscriptions

Optional content and software subscriptions (e.g., the Plus and Pro tiers) are billed on a recurring basis. For pre-orders, the first subscription period may be prepaid as part of the order balance and the recurring subscription begins when your unit ships. Subscriptions renew automatically until cancelled. You may cancel a subscription at any time through your account portal or by contacting us; cancellation stops future renewals but does not retroactively refund a current period except where required by law.

6.Shipping and Risk of Loss

Shipping terms, timelines, and your right to cancel for late shipment are described in our Shipping Policy. Risk of loss passes to you upon delivery to the carrier.

7.Offline Appliance and Content Disclaimer

The SurviveRx appliance and its bundled reference content (including medical, survival, and emergency-preparedness materials and AI-generated responses) are provided for general informational purposes only and are not a substitute for professional medical, legal, or other expert advice. AI-generated output may be inaccurate or incomplete. In an emergency, contact qualified emergency services whenever they are available. You use the content at your own risk.

8.Acceptable Use

You agree not to resell, redistribute, or sublicense the bundled software or licensed content except as permitted by the applicable third-party licenses; not to reverse engineer the Services except as permitted by law; and not to use the Services to violate any law or third-party rights. The appliance is sold for personal and household preparedness use.

9.Intellectual Property

The SurviveRx name, logos, website, and original software are owned by Offline Resilience Systems. Bundled third-party software and content remain the property of their respective owners and are distributed under their own licenses, copies of which ship with the appliance.

10.Warranties and Disclaimers

Except where prohibited by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the content is error-free or that the Services will be uninterrupted. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

11.Limitation of Liability

To the maximum extent permitted by law, Offline Resilience Systems and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the product or subscription giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

12.Indemnification

You agree to indemnify and hold harmless Offline Resilience Systems from any claims, damages, or expenses arising from your misuse of the Services or violation of these Terms.

13.Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

14.Governing Law

These Terms are governed by the laws of the United States and the state in which Offline Resilience Systems is organized, without regard to conflict-of-laws principles. Mandatory consumer-protection rights in your jurisdiction are unaffected.
